CHARLESTON, W.Va. (AP) — An abortion provider filed a lawsuit Wednesday seeking to overturn West Virginia's near-total ban, saying it is unconstitutional, irrational and causes irreparable harm to the state's only abortion clinic and its patients. The lawsuit asks for a halt to the four-month-old abortion ban while the case is heard in federal court. Republican Gov. Jim Justice on Sept. 16 signed a bill passed earlier that week making West Virginia the second state to enact a law prohibiting the procedure since the U.S. Supreme Court's June ruling overturning its constitutional protection. The law requires abortions to be performed by a physician at a hospital — a provision that at least two Republican lawmakers have said was intended to shut down abortions at the Women’s Health Center of West Virginia. It has provided the procedure since 1976 and was the state’s sole abortion clinic. Under the law, providers who perform illegal abortions can face up to 10 years in prison. … [Read more...] about Lawsuit: WVa abortion ban irrational, unconstitutional

Four things Erik ten Hag got right as Man Utd see off Nottingham Forest to reach Wembley
Manchester United cruised into the League Cup final with an unconvincing but yet comfortable win over Nottingham Forest. Erik ten Hag's side's 3-0 victory over Steve Cooper's men in the first leg meant they were able to play most of the match in second gear. And it was well into the second half before substitue Anthony Martial finished off a sharp counter attack by bundling home a deflected effort from Marcus Rashford that fell kindly into his path. But if the first goal was scrappy, United's second was sublime. Bruno Fernandes found Rashford at the back post with an inch perfect cross, and the Englishman responded by prodding the ball back across goal for Fred to tap in from two yards. Despite the goals, the biggest cheer of the evening was reserved for Jadon Sancho, who was brought off the bench for his first appearance since October 22 - Daily Star Sport considers four things Ten Hag got right, after United set up a mouth watering League Cup Final meeting against Newcastle … [Read more...] about Four things Erik ten Hag got right as Man Utd see off Nottingham Forest to reach Wembley

Warning over Labour’s ‘highly dangerous’ NHS self-referral plan as analysis claims 5,000 cancer cases ‘could be missed’ every year
Thousands of cancer diagnoses could be missed each year under Labour's plans for self-referrals on the NHS , new figures suggest. Sir Keir Starmer wants patients suffering back pain to bypass their GP and go straight to a physiotherapist. But new analysis suggests more than 5,000 cancer diagnoses could be missed each year under the proposal. Pro-gun judge targeted by Newsom might have the Supreme Court on his side
This is a carousel. Use Next and Previous buttons to navigate 2 It’s not generally prudent to criticize the umpire before the start of a ballgame, or the judge who’s expected to consider the constitutionality of the new law you’re proposing. But Gov. Gavin Newsom didn’t mince words Wednesday in referring to U.S. District Judge Roger Benitez of San Diego, who is likely to have the first look at gun groups’ challenge to a bill that would restrict the carrying of concealed firearms in public. “Look forward toward Judge Benitez’s decision — it's already been written,” Newsom said at a news conference announcing the legislation, SB2 — portraying the judge as not only pro-gun but as so one-sided that he’s made up his mind and crafted his ruling long before the issue reaches his court. He also said Benitez was “likely to overturn our assault weapons ban," a law already in Benitez’s court that prohibits sale of guns with magazines that can hold more than 10 … [Read more...] about Pro-gun judge targeted by Newsom might have the Supreme Court on his side
Feds grant S.F.’s Laguna Honda reprieve on patient transfers until May 19
Federal regulators gave San Francisco’s Laguna Honda nursing home a last-minute reprieve on Wednesday from a potential demand to resume transferring its frail residents from the facility as soon as Thursday. The Centers for Medicare & Medicaid Services informed Laguna Honda on Wednesday that it had granted the hospital’s request for a delay until May 19. The notice came one day before the deadline patient advocates had dreaded, believing it would be a live or die moment in time — literally. Last summer, 12 of the 57 people who were moved out of the decertified nursing home under the first round of forced transfers died soon afterward in cases of suspected “transfer trauma.” A public outcry led the Centers for Medicare & Medicaid Services, known as CMS, to pause the relocations in July . But federal regulators had said they might require Laguna Honda to resume moving its hundreds of residents by Feb. 2, in preparation for the facility to shut down next fall — a fate … [Read more...] about Feds grant S.F.’s Laguna Honda reprieve on patient transfers until May 19
Feinstein’s support of Judge Benitez way back in 2004 turns around and bites her in 2021
When President George W. Bush’s nomination of Roger Benitez to a new federal judgeship in San Diego came under attack in 2004, the nominee drew crucial support from one of Congress’ most vocal advocates of gun control: Sen. Dianne Feinstein. Benitez, a state and federal jurist since 1997, has been praised for his “superb demeanor, intelligence, pragmatism and fairness,” the California Democrat said at a Senate Judiciary Committee hearing in February of that year, according to a transcript quoted by CNN this week. Feinstein said observers also described him as ethical and courteous to all who appeared before him. Seventeen years later, Benitez has become the leading judicial ally of firearms advocates in California, striking down a series of gun-control laws that voters had overwhelmingly approved and portraying the state as an enemy of the constitutional right to keep and bear arms. He appears to invite controversy, as in the opening words of his June 4 ruling that declared … [Read more...] about Feinstein’s support of Judge Benitez way back in 2004 turns around and bites her in 2021
